Reasons for backdating housing benefit

If there has been a reason which stopped or delayed you applying for Council Tax Support you can ask for your claim to be 'backdated' so that it starts from an earlier date.

No changes to good cause The good cause provisions have not changed.

You need to have a good reason for not claiming at the right time; we call this having or showing 'good cause'.

There is no formal definition of 'good cause'; each case will be decided according to its own individual situation.

There are no formal time limits on making a backdate request, but the maximum period that a benefit claim can be backdated is 1 month for customers under 60 years old and 3 months for customers over 60 years old from the date we receive the backdate request. Good causes may include the following, depending on the circumstances.

In this case, we may backdate your benefit to February. If you, or your partner, are of State Pension Credit Age and qualify for Housing Benefit and Council Tax Support (or both), we can backdate your benefit up to 3 months before the date you made your claim (as long as you were entitled to benefit for that period).

However, if you were ill from February to March and had no-one to help you make a claim, but you did not claim until May, we would not backdate benefit to February because you were not ill from March until May and therefore you have not shown continuous good cause. If you are of State Pension Credit Age and you are entitled to benefit from a date before you claimed, we will give you your benefit automatically.

Some examples of when claimants may have "good cause" are; For Example You were ill from February to March and only claimed benefit in March when you recovered but you did not claim before because you had no-one to help you.

If you disagree with the date your claim starts from for any other reason you can appeal against the decision.

In order for a backdate of Council Tax Support to be allowed you will have to show 'good cause' why you did not apply earlier.

Thinking that you may not be entitled to benefit or not knowing that you could claim are not normally good reasons for us to be able to backdate your claim.
